The Local Court of NSW

In NSW, most criminal cases first enter the court system through the Local Court and are determined by a Magistrate. The Local Court deals with the majority of criminal charges, traffic charges, RMS drivers licence appeals, bail applications and summary prosecutions in NSW. Even a person charged with murder starts their case in the Local Court.

Legal Aid may be Available for Your Local Court Matter

Legal Aid is a government organisation which assists people who are disadvantged in our legal system. You may be eligible for a grant of aid (to receive funding to get a lawyer) for your Local Court matter. Simple call us to discuss your assessment and let us help you apply. Even if you are not eligible for Legal Aid, we will always look after you. Our fees are very reasonable and charged on a fixed fee agreement to keep costs low for our clients.

The Children’s Court

The Children’s Court deals with criminal charges where the accused (Young Person) is less than 18 years of age at the time of the alleged offence. The Children’s Court also deals with traffic offences where the Accused Young Person is not old enough to hold a driver’s licence. All other traffic offences alleged to have been committed by a person under the age of 18 years are dealt with in the Local Court. Children’s Serious Indictable Offences and Committal hearings – to determine whether or not the charges are to be committed to the District and Supreme Courts. These charges are usually prosecuted by the Office of the Director of Public Prosecutions (ODPP).
